Momoto Mates (Loyalty program)

Introduction

1.1 These are the terms and conditions (Terms) for the Momoto Mates, its website, and social media platforms.

1.2 When you use any part of the service, such as applying to join Momoto Mates, or redeeming discounts via Momoto Mates, you accept these terms.

1.3 If you do not agree with these terms, you should not use the service.

1.4 Momoto can change, suspend, or terminate the service (or any part of it) at any time without notifying you first.

1.5 You may only use the service and provide personal information if you are an Australian resident aged 15 years or over. If you are under 18, you need your parent or guardian’s consent.

1.6 Once you use the service, you are bound by these terms. If applicable, your parent or guardian who provided consent on your behalf will also be bound.

How to Join Momoto Mates

2.1 To receive and redeem benefits, you must first join Momoto Mates (explained below).

2.2 You can join Momoto Mates by:

• Scanning the QR code in a Momoto restaurant
• Registering on Momoto’s website

2.3 You must provide current, correct, and complete information when you register your membership.

2.4 You are only able to register and maintain one (1) membership, and the membership must be in your own name. You cannot use another member’s membership pass.

2.5 Momoto can refuse membership registration requests.

2.6 Momoto personnel may ask you to produce ID to confirm your details and eligibility. If you choose not to provide ID, your membership may be cancelled.

2.7 The length of membership benefits will continue at Momoto’s discretion.

2.8 If Momoto terminates Momoto Mates, you will have until 30 days from the termination, or until the expiration date of your benefits, whichever is earlier, to use your benefits. Momoto will not be liable for the termination or loss of your benefits.

2.9 Momoto sometimes offer promotions for members, which are subject to additional terms as well as these terms. Momoto also run other promotions outside Momoto Mates. They are run in accordance with their own terms.

Benefits

3.1 Momoto may offer discounts, membership points, promotions, or other benefits to members. Momoto can decide about the nature, quantity, availability, and award of benefits at its discretion.

3.2 To redeem a benefit, you must follow the instructions provided by Momoto. You are responsible for any additional costs which you may incur in redeeming a benefit.

3.3 Benefits must be redeemed within the stated period, otherwise, they will expire. There may be limits on the number of benefits you can receive, or other conditions. These benefits and conditions may be changed without notice subject to the Australian Consumer Law.

3.4 Subject to your rights under the Australian Consumer Law (ACL) and these Terms, Momoto is not responsible if a benefit is or becomes unavailable. If a benefit or part of it becomes unavailable for a reason beyond our reasonable control, Momoto can award a similar item of equal or greater value. Also, subject to your rights under the ACL, Momoto is not responsible for any variation in benefits or their value.

3.5 It is your responsibility to ensure that benefits are suitable for you.

3.6 Momoto personnel may ask you to provide photo ID to confirm you are the membership holder before you can redeem a benefit.

3.7 Benefits must be taken as offered and cannot be sold, transferred, assigned, or otherwise dealt with. Benefits are not replaceable if expired.

Momoto Mates Rewards

4.1 Thank you for signing up for Momoto Mates membership pass.

4.2 You will receive one (1) reward point for every one (1) full dollar that you spend on food and beverages, based on the subtotal before any rounding.

4.3 You can earn points on any food and beverage item that you purchase.

4.4 Note: there may be promotional items on the menu that provide double points.

4.5 You can redeem a flat $10 dollars discount for every 100 points.4.6 Momoto Mates members can redeem up to 500 points or a $50 discount on each transaction. However, members must spend a minimum of $1 above the redemption value for each point level. Points redemption options are available at 100, 200, 300, 400, and 500 points.4.7 Membership points would still be earned whenever a transaction includes a discount redeemed by points.

4.8 Other vouchers can be used concurrently to earn membership points; however, points earned from the transaction will be based solely on the actual $ amount paid, regardless of any discounts or vouchers applied.

4.9 Note: There may be items with specific discounts up to 100% off, redeemable through membership points.

4.10 Any points accumulated through Momoto Mates are non-transferable. Points cannot be combined across multiple memberships. Points have no cash value.

4.11 You can redeem your points when you pay at the cashier. Allow the cashier to scan your digital membership card (via Apple Wallet/Google Pay) or provide personal details that you signed up with.

4.12 Points accumulated during a transaction cannot be redeemed within the same transaction, and must be saved for redemption for a future purchase.

4.13 A membership pass must be scanned at the time of purchase. Once the transaction has been completed, late requests to add points to a membership pass afterwards will not be accepted.

Use of the Service

5.1 All material and logos on the Service remain Momoto’s property.

5.2 You must not attempt to decompile, reverse engineer, disassemble, or otherwise convert the Service.

5.3 Momoto disclaims responsibility for the content of external websites, social media platforms, or applications linked on the Service, as they may operate under their own terms and conditions. Additionally, Momoto is not liable for third-party promotions featured on the membership pass or associated discounts.

Privacy

6.1 Momoto handles your personal information in compliance with the privacy collection statements provided to you, as outlined in the Terms of Service.

6.2 Momoto collects and use your personal information through the Service for the purposes disclosed when Momoto collects the information and allow you to:

• register a membership.
• receive and redeem Benefits.

And to allow Momoto to:

• contact you with information about the Service, including special offers, promotions, market research, or marketing materials.
• share your personal information with Momoto’s business partners if they are involved in your customer service.
• use your personal information for reasonable marketing purposes.

6.3 By signing up for Momoto Mates, You consent to receiving marketing materials via the information you have provided, you can unsubscribe to Momoto marketing materials anytime.

6.4 If you decide not to provide us with your personal information, At its discretion, Momoto may not be able to process your membership or provide you with Benefits, and it may restrict your ability to use the Service overall.

6.5 Keeping your personal information safe is important to Momoto. However, security of communications cannot be guaranteed and to the extent permitted by law, Momoto is not liable for unauthorized access.

General

7.1 Momoto can monitor membership activity. Momoto can terminate or suspend membership, including if Momoto sees signs of fraud, criminal abuse, or suspicious activity, or any breach of these Terms. Momoto reserve its rights in the case of any breach of these Terms, or any terms of the promotion, or our rights, or any unlawful activity.

7.2 If Momoto believes you are using any automated software or other mechanical or electronic automated method to receive points and/or redeem Benefits, or to take advantage of Momoto Mates or other promotions, Momoto can suspend or terminate your membership.

7.3 Momoto disclaims all warranties of merchantability, non-infringement, and fitness for a particular purpose. Additionally, Momoto does not warrant that the Service will be error-free or free from harmful code.

7.4 To the extent permitted by law, Momoto has no liability for any loss or claim that you may suffer or incur as a result of your use of the Service.

7.5 Momoto’s service comes with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You have rights under the ACL for major and minor failures. For a major failure, you may be entitled to a refund or compensation for the reduced value of goods or services. For a minor failure, Momoto may choose to provide you with a replacement or refund for goods or services, or re-supply a service.

7.6 To obtain compensation, you will need to provide documented evidence of the loss or damage suffered, and documentary evidence that such loss or damage was a reasonably foreseeable consequence of our failure to comply with a consumer guarantee under the ACL.

7.7 The type of remedy Momoto will offer you may vary depending on how long it takes you to make a claim.

7.8 Our decisions about all aspects of Momoto Mates are final and no correspondence will be entered into.

Governing Law & Amendments

8.1 These Terms are governed by the laws of NSW, QLD, SA, WA. You submit to the exclusive jurisdiction of the Courts of Commonwealth of Australia in respect of all matters and things arising out of these Terms and Conditions.

8.2 Momoto amend these Terms when needed and without notice to you, so you should check them from time to time. Your use of our Service, following any changes, is your acceptance of those changes.
